The Fernando principles: Sentencing Indigenous offenders in NSW
Released in February 2010, this report provides a comprehensive review of the development of the common law principles in relation to sentencing Indigenous offenders against a backdrop of increasing rates of imprisonment of Indigenous offenders in NSW. The report identifies various reasons for the overrepresentation of Indigenous offenders in NSW prisons and examines alternative sentencing models and criminal justice strategies from this and other jurisdictions.
